Terms and Conditions
These Terms & Conditions apply to all services provided by Evolved Mind Body, including Kinesiology sessions and the 12-Week Nervous System Reset Program.
By booking an appointment, purchasing a program or otherwise engaging with Evolved Mind Body, you acknowledge that you have had an opportunity to read and understand these Terms & Conditions, including the information provided about the collection and handling of your personal information.
1. General Terms & Conditions
1.1 Appointments & Bookings
Appointments are available by booking online through the Evolved Mind Body booking system or by arrangement directly with Evolved Mind Body. Your appointment is confirmed once your booking has been received and any required deposit or payment has been made.
Please ensure the contact details you provide are correct so appointment confirmations, reminders and other important information can reach you.
Appointments are reserved specifically for you. By booking an appointment, you are committing to the allocated appointment time.
1.2 Cancellation & Rescheduling
Appointments are reserved specifically for each client. Late cancellations and missed appointments mean the appointment time cannot usually be offered to another client. A minimum of 24 hours' notice is required to cancel or reschedule an appointment.
Cancellations or rescheduling made more than 24 hours before your appointment can be made without penalty.
Cancellations made within 24 hours of your appointment will result in your deposit being forfeited. No-shows will result in your deposit being forfeited.
Where a deposit has not been paid, Evolved Mind Body may decline to hold or rebook an appointment until payment arrangements have been made.
Repeated late cancellations or missed appointments may result in future appointments requiring full payment at the time of booking.
If you are running late, please let me know as soon as possible. Your session will generally still finish at the scheduled time so other clients are not impacted. The full session fee remains payable.
I understand that unexpected circumstances can arise. Genuine emergencies and exceptional circumstances may be considered at the practitioner's discretion.
Nothing in this cancellation policy is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law.
1.3 Practitioner Cancellations
Occasionally, Evolved Mind Body may need to cancel or reschedule an appointment due to illness, an emergency or circumstances outside our reasonable control. Where this occurs, you will be offered an alternative appointment time.
If an alternative appointment cannot reasonably be arranged, any payment made specifically for the cancelled appointment will be refunded.
1.4 Payments
A deposit is required at the time of booking unless an alternative arrangement has been agreed in advance. The remaining balance, where applicable, is payable at or before the appointment unless otherwise agreed.
Prices are displayed on the Evolved Mind Body website and booking platform and may change from time to time. In the instance where prices change, reasonable notice of the change will be provided. Price changes will not affect appointments or programs that have already been paid for in advance. For programs or packages, the payment arrangements applicable to that program will be confirmed before enrolment.
1.5 Late Arrivals
Please arrive or connect online at your scheduled appointment time. If you arrive late, your session may need to be shortened so that the next appointment can begin on time.
The full appointment fee remains payable and the session will not ordinarily be extended to make up for lost time.
1.6 Confidentiality & Privacy
Evolved Mind Body respects your privacy and is committed to protecting the personal information you provide.
Evolved Mind Body complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) in relation to personal information and health information.
Information We Collect
Depending on the services you access, we may collect your name and contact details, appointment and payment information, intake and health history information, health and wellbeing information, information about your goals and progress, and other information you choose to provide during your sessions or communications with us.
Some information collected through Kinesiology and the 12-Week Nervous System Reset Program may be health or other sensitive information.
How We Use Your Information
Your information is collected and used where reasonably necessary to:
provide and personalise our services;
understand your individual needs and goals;
manage appointments and payments;
maintain appropriate client records;
communicate with you about your appointments and services;
provide program resources and support;
meet legal, insurance and business obligations; and
send marketing communications where you have consented or where otherwise permitted by law.
We do not sell your personal information.
Third-Party Providers
Evolved Mind Body uses trusted third-party providers to assist with the operation of the business, including booking, online forms, payment processing, email, website and cloud-based services.
These providers may store or process your information on our behalf, and some may be located outside Australia. We take reasonable steps to ensure personal information is handled in accordance with applicable privacy requirements.
Storage & Security
We take reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification or disclosure. Information is retained only for as long as reasonably necessary to provide services and meet applicable legal, accounting, insurance and professional obligations.
Access & Correction
You may request access to personal information we hold about you and ask us to correct information that is inaccurate, incomplete or out of date.
Privacy Concerns
If you have a concern about how your personal information has been handled, please contact Evolved Mind Body in the first instance so we can investigate and respond to your concern.
1.7 Communication
Where appropriate, Evolved Mind Body may contact you by email, SMS or telephone regarding appointments, bookings, program information and other communications relating to your services.
You may opt out of non-essential marketing communications at any time. Opting out of marketing communications will not affect essential communications relating to appointments, payments, bookings or services you have requested.
1.8 Scope of Services
Evolved Mind Body provides complementary and holistic wellbeing services. Services are designed to support wellbeing, self-awareness, stress management, nervous system regulation and mind–body connection. They are not intended to replace medical care, psychological treatment, diagnosis or advice from an appropriately qualified healthcare professional.
Evolved Mind Body does not diagnose medical conditions or prescribe, alter or discontinue medication.
If you have a medical or psychological concern, please seek advice from an appropriately qualified healthcare professional.
1.9 Individual Results
Every person responds differently to complementary wellbeing services. Evolved Mind Body provides individualised support and evidence-informed education and practices where appropriate. Your experience and progress may be influenced by many factors, including your individual circumstances, health, environment, lifestyle and participation between sessions.
2. Kinesiology – Specific Terms & Conditions
2.1 Nature of Kinesiology
Kinesiology at Evolved Mind Body is a complementary wellbeing practice that incorporates muscle monitoring, acupressure, gentle physical techniques, sound and other complementary mind–body approaches.
Sessions are designed to support awareness of patterns of stress and encourage greater connection between the mind, body and nervous system.
Kinesiology is a complementary modality and is not a form of medical diagnosis or treatment. Any information discussed during a kinesiology session is provided for educational and wellbeing purposes and should not be interpreted as medical advice.
2.2 Informed Participation
Before your first kinesiology session, you will be asked to complete an intake and health history form.
During your session, your practitioner will explain the techniques being used and invite you to participate in different techniques or activities.
You are always welcome to ask questions, request an explanation or decline a particular technique. You can stop or pause a technique at any time if you feel uncomfortable.
Your consent and comfort are important throughout the session.
2.3 Physical Contact
A kinesiology session involves gentle physical contact throughout the session, such as muscle monitoring or acupressure. The practitioner will explain the nature of physical contact where appropriate.
You may decline physical contact at any time or ask for a technique to be stopped.
2.4 Emotional & Somatic Responses
Kinesiology can often increase awareness of emotions, memories, thoughts, sensations or physical responses.
You are not required to discuss or disclose anything you do not wish to. Sessions are approached at a pace intended to support safety, choice and individual capacity.
If significant emotional or psychological concerns arise, you may be encouraged to seek additional support from an appropriately qualified mental health professional.
2.5 Medical Care
Kinesiology should be used alongside, rather than instead of, appropriate medical and healthcare support.
You should continue any treatment, medication or care recommended by your healthcare professionals unless they advise otherwise.
3. 12-Week Nervous System Reset Program
3.1 About the Program
The 12-Week Nervous System Reset Program is an individualised wellbeing program designed to support greater awareness of the relationship between the nervous system, body, thoughts, emotions and everyday experiences.
The program combines education, somatic practices, nervous system regulation strategies and personalised support.
The program includes:
6 personalised 60-minute one-to-one sessions;
6 check-in sessions;
individualised practices and strategies;
resources and exercises to support integration between sessions;
ongoing guidance throughout the program;
and a tailored approach based on your individual needs and goals.
The program is designed to be completed over approximately 12 weeks.
3.2 Program Commitment
The 12-Week Program is a structured program rather than a series of unrelated individual appointments.
When you enrol, you are reserving a place in the program and committing to the program as a whole.
The program fee relates to the complete program and its associated support, resources and sessions.
Individual sessions within the program are not transferable to another person.
Goals are discussed and established at the beginning of the program, and the program is designed to work towards these goals in a flexible and individualised manner.
3.3 Program Scheduling
Program sessions will be scheduled with your practitioner. Where possible, sessions will be arranged at mutually suitable times. If you need to reschedule a program session, the standard 24-hour cancellation policy applies, section 1.2 Cancellation & Rescheduling.
3.4 Participation
The effectiveness of the program depends in part on your participation and willingness to engage with the process.
You may be provided with practices, exercises, reflections or other resources to use between sessions.
These are intended to support your learning and integration, and are not compulsory medical treatments.
You are encouraged to communicate openly with your practitioner about what feels supportive, challenging or unsuitable.
You are always encouraged to work within your own capacity and to stop any practice that causes significant discomfort or distress.
3.5 Program Adjustments
The program is personalised and may be adjusted throughout the 12 weeks according to your individual needs, circumstances and progress.
The content, focus and practices may therefore differ from person to person.
Open communication is encouraged throughout the program to ensure the program is appropriately supporting the goals identified at the beginning of the program.
3.6 Pausing or Discontinuing the Program
If circumstances arise that mean you are unable to continue with the program, please contact Evolved Mind Body as soon as possible.
Where appropriate, we may discuss options such as rescheduling or temporarily pausing remaining sessions.
Any request to pause, transfer or discontinue a program will be considered on a case-by-case basis, taking into account the circumstances, services already provided and any applicable consumer rights.
3.7 Payment Plans
Where a payment plan is offered, the payment schedule will be agreed at the time of enrolment.
If a payment is missed, Evolved Mind Body will contact you to arrange payment.
Access to future sessions, resources or program support may be paused until outstanding payments are brought up to date.
3.8 Program Support
Any email, messaging or other support included within the program is intended to complement scheduled sessions. It is not intended to provide emergency, crisis or medical support.
Evolved Mind Body does not provide emergency or crisis services. If you are experiencing an emergency or are at immediate risk, please contact emergency services or an appropriate crisis or healthcare service.
3.9 Medical & Psychological Support
The 12-Week Program is a complementary wellbeing service. It is not a substitute for medical care, psychological therapy, counselling, psychotherapy or other professional healthcare services. The program does not diagnose, treat or cure medical or psychological conditions.
If you are experiencing significant physical or psychological symptoms, please seek appropriate support from your GP, medical practitioner, psychologist or another suitably qualified professional.
Where appropriate, your practitioner may recommend that you seek additional professional support.
3.10 Emotional & Somatic Experiences
Somatic and nervous system practices may bring increased awareness of physical sensations, emotions, thoughts or patterns of behaviour. The program does not require you to revisit or disclose traumatic experiences. You remain in control of what you choose to discuss or explore during sessions.
Your practitioner will work collaboratively with you and may modify or discontinue a practice if it does not appear appropriate for your current capacity.
4. Program Resources & Intellectual Property
Any worksheets, guides, exercises, recordings, videos, educational materials or other resources provided by Evolved Mind Body remain the intellectual property of Evolved Mind Body unless otherwise stated.
Resources are provided for your personal use only.
You may not reproduce, copy, distribute, publish, sell, share or commercially use these materials without prior written permission.
You are welcome to use the practices and tools provided within the program in your own everyday life.
5. Website & Educational Content
Information provided on the Evolved Mind Body website, social media, newsletters, workbooks and other educational materials is provided for general educational and wellbeing purposes.
It should not be considered individual medical, psychological or healthcare advice. You should seek professional advice appropriate to your individual circumstances before making decisions about your health or wellbeing.
6. Australian Consumer Law
Evolved Mind Body complies with the Australian Consumer Law, including applicable consumer guarantees and protections, and nothing in these Terms & Conditions is intended to exclude or limit any rights you have under that law.
7. Changes to Services & Terms
Evolved Mind Body may update its services, pricing, policies and these Terms & Conditions from time to time. The current version will be published on the Evolved Mind Body website. Changes to these Terms & Conditions will not retrospectively alter the terms applicable to a service or program that you have already purchased, except where required by law or where otherwise agreed.
Where a significant change affects an ongoing program, Evolved Mind Body will provide reasonable notice where practicable.
